Fixed costs extension likely to result in more ADR and Mediation

It has been announced that the fixed costs regime will be extended to claims over £100,000 except personal injury claims from October 2023. When costs that are recoverable are limited we consider it likely that parties will be more willing to settle because otherwise they risk spending more on costs than they recover. We do not know the amount of fixed costs allocated to these cases which creates uncertainty for law firms and clients. It would be better if these figures could be released now.
