Mediation is frequently suggested by one or other party to a dispute but it takes both parties to agree to use it.
The Courts are now promoting mediation through the Pre-action protocols, the directions questionnaire that the parties have to complete in each case and in the new Online Court which is being developed.
Mediation is coming of age because parties want to reduce risk and legal spend. They also appreciate the confidentiality that a mediated settlement can bring, as well as finality and avoiding the stress and cost of legal proceedings which only benefit the lawyers. By spending or allocating less to the legal proceedings, there is more available to fund a settlement.
