- We have long lobbied for businesses to engage with the ADR Regulations for consumer disputes as many refuse to use ADR, preferring to defend claims and shunning compromise. Sadly we left the EU and with it the EU dispute resolution process. Proposals have now been made by the EU regarding the Consumer ADR Regulations. The main points are as follows:
- ODR platform is being considered and proposals are to replace it with an ADR signposting/landing page.
- There is a consultation currently open (closing in December) that might be of interest in terms of policy direction and potential divergence:Alternative dispute resolution for consumers | European Commission (europa.eu)
- Strengthening ADR by requiring a business response.
unfortunately although these changes would be beneficial in the UK to consumers we may not follow developments for political reasons.
