Why hasn’t the Civil Justice Council’s mediation report been implemented?

Last December, over 6 months ago, the Civil Justice Council published its report on mediation and the justice system. It recommended various steps to encourage mediation, including a Notice to Mediate procedure.
It should perhaps come as no surprise to learn that NO steps have yet been taken to implement the report, leaving litigants with fewer opportunities to resolve their disputes, which is disappointing for litigants, Court users and the mediation profession. Although these things take time, we don’t understand why the liaison committee hasn’t been set up yet.
In the meantime at ProMediate we continue to encourage people to use mediation and to save costs. We run the Manchester Mediation Pilot which at least provides good value mediation for Court users in that area.
